Mainland vs. Freezone & UAE Commercial VAT
Navigating jurisdiction rules is critical before signing any commercial lease in Dubai.
DED Mainland vs. Freezone Jurisdictions
In Dubai, the physical location of your commercial premises is legally bound to your business license jurisdiction. Companies registered under the Dubai Economy and Tourism (DET / DED Mainland) can lease commercial premises across all non-freezone and designated mainland buildings in the Emirate.
Conversely, companies established in specialized freezones like DIFC, DMCC, or JAFZA must lease office premises situated within that freezone's physical boundaries to validate their Ejari and trade license renewals, unless operating under official dual-licensing permissions.
5% UAE Commercial Property VAT
Unlike residential leases which are exempt from VAT, all commercial leases and commercial property acquisitions in the UAE are subject to 5% Federal VAT under Federal Decree-Law No. 8 of 2017. Businesses holding a UAE Tax Registration Number (TRN) can claim back this VAT as input tax on their quarterly Federal Tax Authority (FTA) tax declarations.
